Jurors watch Seng Yang remove his daughter's clothes, position the camera and perform various sex acts on a lifeless Jane Doe

There were two short videos on Seng Yang's cell phone. The names of the video were the two items that former DA Investigator Martin Perrone testified about yesterday.

There was a three minute video, "I essentially shows a female pelvic," Eureka Police Department Senior Det. Ron Harpham was testifying and Deputy Public Defender Luke Brownfield objected.

Since the videos were going to be shown to the jury, his onjection was sustained.

"The third video was on a thumb drive from a different evidentiary pool," said Det. Harpham. "It was located on Google Drive tied to Mr. Yang's Gmail account."

Det. Harpham wrote a search warrant and there were 159  vigabytes of videos and photos with dates they were uploaded. "There was a year worth of videos," said Det. Harpham. He found three videos relevant to the investigation and viewed them.

The first video was 25 seconds,uploaded on Oct 1,2017. "It was video in a darkened room," said Det. Harpham. Again, Mr. Brownfield objected.

Deputy District Attorney Stacey Eads asked to approach about videos 2 and 3. There was a break while attornets met with the Judge in a closed courtroom.

After the break, Detective Harpham said the first video was uploaded on October 1,2017 and "was 25 seconds long". The second video was uploaded on October 13, 2017 and "was 8 minutes, 2 seconds long. " The third video was
uploaded on October 16, 2017 and "was 33 minutes, 26 seconds long."

Exhibit 53, a thumb drive contained the October 13, 2017 and October 16 ,2017 video.

Exhibit 54 contained the October 13, 2017 video redacted to 3 minutes and the October 16, 2017 video redacted to 10 1/2 minutes.

Mr. Brownfield objected. There has already been a ruling on the videos. Judge John Feeney said foundaton had been established and he had balanced on 352and defense objections were overruled.

The first video was played. At the very end of the video, you see part of a female face. It is Jane Doe. There is heavy breathing and you see a close up of a male penis entering and thrusting a female vagina. The male ejaculates and then penetrates the female, again. This is in the missionary position.

In the second video, again in missionary position, you see a male penis thrusting and at times ramming into a female vagina, ejaculate, pull out and ejaculate on top of the female vagina. Same genitals, close up. There are no faces visible in this video.

The third video you see a naked man adjusting the camera in a room and a girl with her head down sitting on the bed.

Court recessed for lunch.

In the afternoon session, two more videos were played. In the first video which  was redacted to three minutes in length,  you see Yang. He positions Jane Doe, takes her underwear off, performs oral sex on her for a few seconds and then penetrates her. This is in the missionary position.

For the last video, redacted to 10 1/2 minutes a transcript was or provided to the jurors. When Det. Harpham testified about this video at the preliminary hearing, he teared up and choked up. All the videos were extremely difficult to watch but this was the hardest to watch. You can hear and clearly see Yang and Jane Doe.

A naked Yang is on top of Jane Doe who just lays there expressionless and still. Yang manipulates her body and you can hear moans and grunts. First he is standing over, penetrating her,thrusting at different speeds. Then he raises her legs up and penetrates her. And at the very end, still fucking her, he lifts up like a rag doll and straddles her. During the video,you hear a knock and a little child's voice. Yang doesn't stop but tells the child to go away. I could not hear what he was saying or whether he was talking in English or Hmong.

Jane Doe had a shirt on that Yang kept moving wuth his hand.

During her estimony from the jury trial, Jane Doe said her father never wore a condom during sex.  During the preliminary hearing, Det. Harpham testified every time Yang had sex with his daughter, he did so until he ejaculated.

Deputy District Attorney Stacey Eads asked Det. Harpham how he identified the parties in the first three videos.

Det. Harpham said in the very first video, you see a person on their back holding a phone. He slowed it down frame by frame and "it's see Jane Doe's face."

From the metadata, the videos were filmed on the same day and the "person on their back is in the same shirt."

Regarding "the male part", Det. Harpham compared the belly button and the pubic hair, "the erect, uncircumsized penis, ejaculating in the same manner, same pink ring in foreskin."

The third video was filmed in the living room on the couch.

In the last video, the redacted video did not include "Yang lifting up Jane Doe's shirt and touching her breasts." She would pull her shirt down. Det. Harpham said Jane Doe's expression did not change. She did not remove Yang's clothing.
