Defense asked for a not guilty verdict on Counts 1-13 in Seng Yang case



Deputy Public Defender Luke Brownfield said the People have not proven their case beyond a reasonable doubt. He said that the prosecution had not met the burden that "Jane Doe did not consent."

Several times he brought up separating emotions from facts.

"There are a number of crimes Mr. Yang committed." He then picked up and showed jurors the book that contains the Penal Codes. "What Mr. Yang did broke a lot of the law. "

You are asked whether he broke 16 of these laws . A number of these laws he didn't break."

"Incest, law with a minor he broke." Mr. Brownfield said  in Counts 2 -13 are charged with forcible rape. He argued about what age Jane Doe was when these acts were committed.
Mr. Brownfield claimed Jane Doe was not 13 the first time Yang raped her.

"If she is over 14, you have to vote not guilty. I know emotionally you don't want to," but as jurors he told them they had to follow the law.

Mr. Brownfield showed jurors the transcript of Jane Doe's testimony. He asked them to look at her testimony, look at facebook messages and videos . Mr. Brownfield read some selective quotes from Jane Doe's testimony.

He brought up that she had no SART exam and no injuries.

"I am not telling you what Mr. Yang did was right. I am not telling you what Mr. Yang did is legal."

Mr. Brownfield asked the jurors to vote not guilty on Counts 1-13.
