The jurors are seeing Seng Yang's manipulative and controlling side and he has himself to blame
Day 2 of Seng Yang's trial was another long and exhausting one. Yesterday at 2 p.m. jury selection started with 73 jurors. Today by 4:45 p.m., we are down to 20 jurors and the 12 jury members have not been finalized.
Some of this has been due to jurors admitting that they cannot be fair and impartial after hearing the charges. They thought they ould but after sitting through jury selection, they feel differently.
Some jurors work in the legal system or with abused and neglected chidren. Others are teachers or parents. They were excused by stipulation.
But the major delay has been Yang. A juror asked whether it was fair of Yang to give input to his attorney. Judge John Feeney said that is his right. The juror made a good observation. Yang is giving more than input. Other defendants gave input, they didnt take charge, Yang has used every preemptory challenge to get rid of several jurors, mostly men.
The juror who made this observation was after everyone watched well over 6 or 7 jurors be excused by the defense after Deputy District Attorney Eads was satisfied with the panel of 12.
Given the number of Marsden motion stunts Yang has pulled, including one two days ago, Yang seems to be giving it his best shot to screw up the jury selection process. Anything to delay or get off on a legal technicality.
The jurors dont know about the Marsden motion. Yang is showing them his manipulative side by his own stupidity.
The jurors' frustration is obvious and understandable because Yang did after several jurors were excused by the People or the defense. This was in addition to those jurorsexcused with a change of heart in the courtroom.
This is a savvy jury. They have given thoughtful, honest answers. They are well educated and paying attention to questions asked. They get that there are valid reasons jurors are excused.
They applauded after one male juror was excused. This male juror made no bones about the fact that he did not want to be on the jury loudly in court, in the jury box. He was picked yesterday afternoon and excused today.
Most jurors in the box realize the seriousness of the case, the presumption of innocence and a fair trial and their civic duty.
"The nature of the charges is disturbing but one must separate it from guilt or lack of thereof."
One teacher being honest about his strong feelings reflected the guilt he felt about wanting to be excused by asking, "How is this supposed to work, if juror after juror is excused?"
