"If she resisted, she would be raped more frequently and for longer periods of time."
Opening statements in Seng Yang's jury trial started half an hour later than scheduled. Since Deputy District Attorney Stacey Eads and DA Investigator Kyla Baxley were sitting outside court while interpreters and Deputy Public Defender Luke Brownfield were in the courtroom, I assume Yang turned down another plea deal.
Ms. Eads' opening statement provided a great outline of the case and she went through each of the 16 charges with a timeline. If you read the coverage of the preliminary hearing coverage, most the information will be familiar.
"Jane Doe is the third child of Jimmy Yang and Kristy Lee," said Ms. Eads. The sexual abuse started when Jane Doe was 12 years old with Yang laying on top of her and touching her vaginal area over and under clothing while he masturbated. This happened in Jane Doe's bedroom.
At 13 years old, Jane Doe decided to seek help from her mom. She told her mother she had something important to tell her but was not able to do so. Lee told Yang that Jane Doe wanted to talk to her about him.
Later that day, Jane Doe was "raped the first time by her father." Ms. Eads said Jane Doe learn to submit to her father and "over time stopped physically resisting. If she resisted, she would be raped more frequently and for longer periods of time." Yang would become angry.
Yang told Jane Doe if she submitted, he would leave her siblings alone and the rapes would be less frequent.
"Her mom caught him. She did nothing." Ms. Eads said that one night, it was late and Lee discovered Yang "completely naked" in a room with her daughter. There was a confrontation between Lee and Yang. "Nothing changed."
On January 5, 2018, the day before Jane Doe's 15th birthday, Jane Doe went to EPD and told them about the "enduring sexual abuse she suffered at the hands of her father."
"Perhaps the best gift she could have given herself."
Ms. Eads said there is evidence corroborating Jane Doe's statement which includes conversations, photos and videos.
Jane Doe's mother will testify she did nothing. Officer Huynh is the first officer that had contact with Jane Doe.
Eureka Police Detective Richard Bise "executed the search warrant at defendant's residence. " He will testify about the electronics, including the mounted camera next to the bed.
Former DA Investigator (who is now a Humboldt County Sheriff Deputy) Martin Perrone will testify about the forensic data from Yang's Samsung cell phone and Google account.
EPD Senior Detective Ron Harpham who interviewed Yang will testify that the "defendant acknowledged wrongfulness, apologized and indicated he was the individual responsible for these crimes." Yang told Det. Harpham that the "videos were made because of the financial difficulties the family was having."
