"Court staff is making Herculean efforts to get this case out."


Trial assignment was scheduled for Scott Eden this morning. Eden was previously convicted and sentenced  for spousal rape. His case was reopened and in January, the second trial was in the middle of jury selection. Nine days into the jury trial, jurors were sent home.

There was a mistrial declared.

Deputy District Attorney Stacey Eads is the prosecutor for the case. Deputy Public Defender Wade Orbelian is Eden's attorney.

After sharing the same information from last time about expert availability, Mr. Orbelian said that he wanted his experts to testify in person.

Ms. Eads said that this was "news" to her and she thought Mr. Orbelian was agreeable to experts testifying via Zoom.

One expert is from Toledo and Ms. Eads said she would prefer not to have people come in from outside the community to testify.

In a nutshell, all this will impact expert availability.

After Mr. Orbelian objected to trial assignment being continued to next Friday,  Judge Christopher Wilson said, "We are doing our best to get this case out. "

He explained that there were other matters and "Court staff is making Herculean efforts to get this case out."

Court staff is trying to get another courtroom opened up. With COVID 19 challenges, Judge Wilson explained that it will take time to get a jury panel together. There is also another trial going on. He asked attorneys for flexibility. Ms. Kelly Nyberg asked counsel for alternative dates for experts.
