A motion hearing to modify terms of release on bail for Sean Allman was scheduled for this morning.
Deputy District Attorney Whitney Timm filed an opposition yesterday. One of the requests by the People is that the people who want the no contact order modified be identified.
Mr. Ben Okin expressed concerns about that request while understanding why the DA made the request.
Mr. Okin said there are two aspects of the terms that defense is requesting be modified.
One is to allow Allman to go north on the freeway on 101; he would agree to stay away from the HSU campus.
The other was clarification about the no contact order. "I thought it was to stay away from the people he sent text messages to; not everyone in the local area."
Allman is charged with Count 1 Terrorizing or Obstructing Exercise of Religion. Count 2 is Criminal Threats. Both counts pertain to the Episcopal Diocese of Northern California.
Retired Judge Marilyn Miles continued the hearing to December 12 to allow Mr. Okin to provide the letter from the local Episcopal church to the Court. Judge Kelly Neel set the terms of release; another Judge may rule on the motion.
Allman was in court by himself. While waiting for his case to be called, Allman asked me if it was okay and if he had time to use the restroom.
