After she was hit, alleged victim in Jeff Tsarnas' case says she crawled on the bridge because her ankle was mangled


There is what Jeff Tsarnas told CHP Officer Matt Harvey, there is what Barbara Craft said Tsarnas told her, there are 5 witnesses but only one who saw the collision and there is the alleged victim statement and her testimony today in court and then there is evidence.



According to today's testimony, only the victim had a conversation with CHP that night. Every one else did the next day or days later after information was all over social media and there had been news articles.

What is clear from evidence is Tsarnas was aware he hit something and he left the scene.

Craft said Tsarnas told her he was glad CHP did not impound the car or they would have found the bottle of brandy on the floorboard.

Tsarnas claimed that he thought he had hit a dog or block of wood. Craft told CHP Officer Harvey, that she said to Tsarnas, "You knew you hit her."

Tsarnas responded, " Well, duh, yeah, yes, but I am not going to say that."

Tsarnas was driving Craft's car to Bear River Casino the night he allegedly hit Marie Kelly. They decided to go to law enforcement after the mirror from Craft's Toyota was found on scene and displayed on social media.

Kelly was credible, even tempered, even during cross examination. She said she walked from Ferndale after an argument with her boyfriend and was supposed to have a friend pick her up. He was supposed to before she got to the bridge. With no cell service and only wifi, she crossed the bridge hoping to get to tge casino and call her friend. She was walking in the middle of the road, looking out for cars. It was not a busy on the bridge. While she was trying to avoid a car traveling towards her, she was hit from behind. There is no shoulder on the bridge and that is why she was walking in the middle of the roadway. She said she usually presses the pedestrian light but was not sure if she did that evening.

A witness who saw the collision described Kelly as being hit, going airborne like a rag doll. If another good samaritan had not stopped, positioned his car to protect Kelly until law enforcement arrived, matters could have been worse. Regarding the weather conditions, different people said different things; the weather conditions in November 27, 2018 can be verified through the local weather service.

Some eyewitnesses said that Kelly had purple medication on her face, was wearing a dark hoodie and was "taunting" or "yelling" at cars and lying in the middle of the roadway as if to commit suicide.

Kelly denied yelling at cars.She said after she was hit from behind, she tried to stand up and couldn't; her ankle was "mangled." So, she crawled trying to cross the bridge.

When Officer Harvey arrived, he found Kelly lying on the roadway and in pain. Dr. Reeves at the hospital told Officer Harvey that Kelly's injuries are consistent with beimg hit from behind by a vehicle.

Kelly has had two surgeries and is scheduled for more. She was in a wheelchair for 5 months. Permanent effects are that she cannot run or hike.

During cross examination, Kelly said she had used meth "in her younger days" but denied being under the influence on November 27, 2018.
