Man who has restraining order filed against him by a Judge declared a vexatious litigant
Sai Rose aka Stephen Gasparas was finally declared a vexatious litigant. That will not stop Rose and his mother from tying up court resources because courtcases filed prior to the order are still in different stages in the system.
Excerpts from ruling:
Cornell defines vexatious litigation as" legal proceedings started with malice and without good case. Vexatious litigation is meant to bother, embarrass, or cause legal expenses to the defendant. A plaintiff who starts such litigation either knows or should reasonably know that no legal basis for the lawsuit exists. To obtain a remedy for vexatious litigation, the injured party often files a claim for malicious prosecution."
Rose has his face plastered at both security entrances at the Courthouse. Unless, he is there on official business, he is not allowed to be at the Courthouse. There is a restraining order filed against him by Humboldt Superior Court Judge Gregory Elvine-Kreis. I have linked previous posts below, including his family law cases. The DA did not file criminal threat charges against Rose for a recent arrest.
Recently there have been restrictions placed on Rose using the law library.
There are two different dates set in January 2020 for Judge Elvine-Kreis' restraining order. I will post the outcome when there is a ruling.
Who hasn't Rose sued?
Google Rose because I don't have the time to waste listing issues with his medical marijuana businrss, his case that went to jury trial for operating a food business without a permit.
