Humboldt courts powerless to protect one of their own?
I attended the Vexatious litigation hearing involving Sai Rose with an out of County Visiting Judge.
The man needed his mother to sit beside him in court even though he is representing himself. After listening to half an hour of his ranting with no concept of the law, I left. The Visiting Judge was very patient listening to Rose, cited the law and put everything on record.
His mother,Patricia Sarlas, is at the Courthouse a lot. Either at the clerk's on 421 I Street or in the Courthouse. Rose has his face plastered at both security entrances. Unless, he is there on official business, he is not allowed to be at the Courthouse.
Judge Kaleb Cockrum and Judge Kelly Neel have recused themselves from the civil harassment order filed against Rose by Judge Gregory Elvine-Kreis. Rose asked that the hearing set for this case on 9/6 be continued to 11/4. Retired Judge John Feeney granted the continuance.
The DA did not file charges against Rose for his recent arrest; the charge was criminal threats.
You can read the posts linked below about his family law cases and one woman's heartfelt sharing of what Rose's release into the community means for her family.
Cornell defines Vexatious litigation as" legal proceedings started with malice and without good case. Vexatious litigation is meant to bother, embarrass, or cause legal expenses to the defendant. A plaintiff who starts such litigation either knows or should reasonably know that no legal basis for the lawsuit exists. To obtain a remedy for vexatious litigation, the injured party often files a claim for malicious prosecution."
If there is a decision in Judge Kreis' case or the vexatious litigation case, I will post an update.
