Defendant Vincent Dix is a free man. A jury came back with a verdict of not guilty. Charge was felon in possession of a firearm. Deputy District Attorney Jane Mackie was the prosecutor. Deputy Conflict Counsel R. J. Leohner was Dix's attorney.
On September 11, Deputy District Attorney Jane Mackie had a jury trial with Deputy Public Defender Casey Russo. On the third day of the jury trial, Retired Judge John Feeney granted defense's request for dismissal.
Jury trial for Dix, including jury selection, started this Monday. Jury deliberations started mid morning. I saw Mr. Leohner leave the Courthouse around 2 p.m.
I have seen Ms. Mackie in court for regular hearings. This isn't about her ability as an attorney. So what is going on at the DA's office? Overcharging? Not pleading cases with weak evidence? Taking cases to trial that should have resolved with a plea? Fallout from three experienced Deputy District Attorneys leaving in 2019?
