It is not impeachment if you haven't refreshed her memory. You are doing it out of order."

Whether the nearly two hour cross examination of Alicia Rose this morning by Brian Leiteritz's attorney, Mr. Michael Robinson, will result in impeachment of her or Terrance Ford remains to be seen.

I am not going to add details of the cross examination. A lot of the cross examination today covered questions asked and answered yesterday.

Judge Marilyn Miles also put on record two observations that I had this morning about Mr. Robinson's cross examination. Mr. Robinson adjusted his cross examination and questions after Judge Miles' remarks.

Judge Miles had a conversation privately, then on Mr. Robinson's request, she put them on record. "I had chided you for asking questions about convictions that had not occurred," said Judge Miles.

Later on, Judge Miles admonished defense again. "I am not taking anything you say as evidence," she said to Mr. Robinson. "It is not impeachment if you haven't refreshed her memory. You are doing it out of order."

Mr. Robinson had indicated he would impeach Rose via HCSO Investigator Scott Hicks' testimony.

Later on, the DA provided a rap sheet for Rose and there was a stipulation to enter it as a defense exhibit. Convictions were highlighted on that rap sheet for the Court to consider.

Remember my mentioning Rose being upset about another woman and Leiteritz. That woman was mentioned today.
