Franklin Molina's case could resolve, counts could be dismissed but we wont know for another month



A 995 motion by the defense to dismiss Counts 1, 6 and 7 was rescheduled for September 19 for kidnapping, robbery and assault suspect Franklin Molina.



Disposition reset is also scheduled for the same date. Deputy District Attorney Trent Timm filed an opposition yesterday and a motion to continue the hearing. He had been in touch with Deputy Public Defender who had no objection to the continuance and will file a response to the opposition. Hearing continued to October 16. Talks of resolution ongoing.

Mr. Timm is starting an attempted murder trial and just inherited former Deputy DA Luke Bernthal's caseload.
