Third day of jury trial and case dismissed on motion by Deputy PD Casey Russo

Today, was the third day of jury trial for Douglas Morrison charged  with first degree burglary. Special allegation that Morrison committed the alleged offense while on felony ptobation in a 2017 case.

The prosecutor for the case was Deputy District Attorney Jane Mackie. Deputy Public Defender Casey Russo was Morrison's attorney. DA Investigator Marvin Kirkpatrick was the lead investigator.

Mr. Russo made a motion citing PC 1118.1 and Retired Judge John Feeney directed a verdict of dismissal.



Under Penal Code 1118.1 the defense counsel can make a motion for judgement of acquittal.The Court considers the motion and grants it if the prosecution has failed to substantiate any element of the charged crime.
