Defense plans to file a motion to dismiss in Brian Leiteritz case



Murder suspect Brian Leiteritz's preliminary hearing is scheduled for today. He is charged with one count of murder; victim is Dylon Liakos. Special allegation is use of a deadly and dangerous weapon, a knife, in the commission of the crime.

9:52 a.m. The preliminary has been assigned to Retired Judge Marilyn Miles. Leiteritz's case is trailing another preliminary.  We waited until about 10:20 a.m  while other cases were called and a preliminary just got started, Leiteritz is schefuled to start next.

Victim's family is here. Leiteritz's supporters here with #freebrian t shirts. One of those supporters is Leah Davis, the woman who gave up the $35,000 claim in the 20.lb meth case.

Ms. Heidi Wells is associate counsel on this case with Mr. Michael Robinson for Leiteritz.

Word is that at the close of evidence, defense plans to file a motion to dismiss today. Whether that happens or not, stay tuned.

Extra court bailiffs in court for a potential flight risk. Could that be Liakos's girlfriend and Leiteritz's ex Alicia Rose?

Leiteritz is charged with one count of murder and special allegation for Count 1 that he used a deadly and dangerous weapon in the commission of the crime.

The People and Leiteritz waived the right to a continuous preliminary hearing.
