Brian Leiteritz held to answer on voluntary manslaughter



Brian Leiteritz was held to voluntary manslaughter, just as I called it in my post yesterday.

Arraignment is on October 3.

Based on the evidence, Judge Marilyn Miles did not hold Leiteritz to answer for the charge of murder, which was the original charge by the People. Leiteritz was held to answer the special allegation as charged in the complaint by the DA.

The defense argument of self defense was not supported by the evidence, which is obvious from Judge Miles ruling. Defense motion to dismiss was denied. Bail reduction request by defense not heard today. Judge Marilyn Miles said it could be scheduled.

Twice, Judge Marilyn Miles had to tell Leiteritz's attorney, Mr. Michael Robinson that this was not a jury trial, to keep his comments relative to the preliminary hearing, that her role was to determine probale caus and that he was not giving a closing argument to a jury.
