Will there be testimony this afternoon in the Brian Leiteritz preliminary?

The morning of day 2 of murder suspect Brian Leiteritz's preliminary hearing was taken up by procedural issues, more courtroom drama and this was before the four day time estimate.

What will the afternoon bring? Will the testimony be relevant to the charges?

Before court opened this afternoon, Deputy District Attorney Steven Steward was talking with Mr. Michael Robinson and Ms. Heidi Wells. No other media was around. Some of Leiteritz supporters were present.

Mr. Steward said he wants to get through Alicia Rose and Terrance Ford's testimony, then HCSO Deputy Eric Losey.

"Do I need to go talk to Ms.Fleming? asked Mr. Robinson.

"If you want to," said Mr. Steward. "I am in search for the truth."

After court opened at 1:45, we took another break at 2:05 after discussions and debate about what the immunity agreement entails.

Mr. Robinson said Ford was found in possession of meth and heroin; Rose in possession of cocaine. Mr. Steward agreed not to prosecute on the alleged felony violation of smuggling drugs in jail.

There was back and forth about the scope of questions. Mr Steward wanted questions limited to what happened on August 9 and 10. Judge Marilyn Miles said dfense can ask questions to impeach Rose dnd Ford.

We are waiting now for the People to provide Rose's arrest reports to the defense and for Conflict Counsel Supervising Attorney to clarify the immunity agreement to Ford. Earlier, Deputy Public Defender Casey Russo spoke with Rose.
