Alicia Rose is in custody

Courtroom 2 has not opened yet. DA Chief Investigator Wayne Cox and Deputy DA Steven Steward just left. Mr. Cox said "She is in court."

Deputy Public Defender Wade Orbelian asked, "Is Alicia Rose here?"

Rose is in custody.  She has other charges.

Chopper is not here. He was arrested on a warrant. Ford was screaming outside the courtroom 2 in cuffs at DA Investigator Martin Morros that he didnt care about his opinion. "I was cooperative. "

Chopper is cooling his heels in a holding cell.

9:38 a.m Deputy Public Defender Casey Russo just walked into Courtroom 2. He was appointed to meet with Rose who glared at Leiteritz briefly, then looked down.


Mr. Robinson stated on record that the DA is offering Rose immunity. "I dont know if Maggie Fleming participated. I am told she did."

 Mr. Robinson said when she was arrested, she was in possession of narcotics, "was given opportunity to get rid of narcotics and then smuggled into jail.

Mr. Robinson expressed his displeasure that Rose was arrested last night and he was not notified until this morning. Both Judge Miles and Deputy District Attorney Steven Steward said Rose was not a surprise witness. Mr. Robinson asked for police and arrest reports for Rose's recent arrest. Mr. Robinson said the defense position on Rose  is that she is a co-conspirator and active participant in the alleged events that took place the night Dylon Liakos was stabbed and power to Leiteritz' house was cut off.

We are on break until 10:30 a.m

11 a.m .Came back to court. Both Rose and "Chopper" aka Terrance Ford were appointed attorneys. Mr. Russo for Rose and Conflict Counsel Supervising Attorney Meagan O'Connell for Ford.

They invoked their right not to self incriminate. People will consider if they want to offer immunity. Court in recess until 1:30 this afternoon.

Retired Judge Marilyn Miles said based on the offer of proof and what she had heard, there was a risk that both Rose and Ford could be held criminally liable.

Rose had the sense to be quiet. Chopper was more subdued but as Judge  Miles explained his rights to him, first he said he did not understand, then the "Chopper attitude returned. "Incriminate myself how? I have not done anything wrong."
