Major screwup by the DA's office who served "Chopper" with an invalid subpoena

Alicia Rose and Terrance Ford were granted immunity by the DA for testifying at the Brian Leiteritz preliminary. Judge Miles told Rose and Ford the immunity does not include perjury.

Deputy District Attorney Steven Steward said the immunity granted is "use immunity not transactional immunity." Rose and Ford will not be prosecuted for statements made at the preliminary hearing.

In "Chopper" aka Ford's case, an oral stipulation was stated on the record that there would be "no new charges will be alleged from this morning regarding resisting arrest and drugs." Given what happened at 4 p.m. this is a moot point.

While discussing the immunity agreement, Leiteritz's attorney Mr. Michael Robinson, brought up that Ford was arrested for possession of  meth and heroin and Rose for possession of cocaine.

At 4 p.m. Ford was brought back at the request of Conflict Counsel Supervising Attorney Meagan O'Connell. He was arrested this morning, however the subpoena served on him was not valid.After being served with another subpoena in court this afternoon, Ford was released and ordered to appear.

Deputy DA Steven Steward said he would have to talk to DA Investigator Marvin Kirkpatrick.

Judge Miles was blunt. She said the subpoena was invalid.

Ford was served with a subpoena via Gmail. The name on Ford's subpoena was Brian Leiteritz instead of Terrance Ford.  Ford lives in Orego and the subpoena was for California.

This is the same Investigator Kirpatrick who could not control Ford yesterday. I never see the rest of the DA investigators unless they are in court or heading out to the field. Kirkpatrick is at the cafe, yakking with other Courthouse or staff or taking his dog out for a walk.

I  feel for Mr. Steward. He is in court trying to prosecute a preliminary hearing with many challenging civilian witneses and
certain DA staff are not helping by their incompetence. It isn't the first time, Deputy DAs have been caught off guard or thrown under the bus in court due to staff errors.

Recognizing that Ford was arrested, booked and humiliated due to an error by the DA's office and that it was late, Judge Miles told Ford, "I don't want to get into what happened this morning."
