Further trial confirmation was scheduled for Gary Cudney this morning. Cudney is charged with the death of Dwight Davis aka "Dirty Dave."
Visiting Judge Garrett Olney had a few words about the defense request to continue the jury trial scheduled for January 6. Time estimate is one month.
Judge Olney did grant the continuance. "What I don't want to happen is what happened today. Few weeks before trial you say witnesses aren't available. "
Jury trial was rescheduled for April.27. Trial confirmation is on April 13.
Another court hearing is scheduled for January 7. "You can represent to the Court that you have been successful in your subpoenas, with the exception of Ms. Perry who is a resident of another country and that your witnesses are available ."
Mr. Daskal said there had been some issues serving PG & E with subpoenas and Judge Olney said that was very troubling.
Deputy District Attorney Steven Steward is the prosecutor for this case. Mr. Manny Daskal is Cudney's attorney.
