Mistrial declared in Chad Smith case, jury deadlocked on 13 counts


For majority of the counts the jury was deadlocked, the votes were 10 guilty and 2 not guilty. For one count  the votes were 9 guilty, and three not guilty. The jurors took 16 different votes.

Yesterday, the split was 7-5. The jury foreperson was not asked yesterday which way the votes were split yesterday.

The jury found Chad Smith guilty on three of the restraining order violations. Smith had already admitted to violating the restraining orders.



The jury was deadlocked on all the sexual abuse charges and one restraining order violation charge.

In court as well as individual questioning, all jurors affirmed they were hopelessly deadlocked.

Trial confirmation was reset for June 12; Jury trial for June 24. Time was not waived.

Sentencing will "trail" the third jury trial. Defense plans to address bail.

"I am pleased that Mr. Smith avoided conviction," said Ms. Andrea Sullivan.

Deputy District Attorney Stacey Eads thanked the jurors for their time.

The jurors left without talking to the attorneys.

This is the second mistrial in Chad Smith's case.
