Alleged molestor's plea deal up in the air


Entry of plea was scheduled for alleged molestor Patrick Marshall today. Now the case may or may not resolve.

Deputy Public Defender Casey Russo appeared 977 for Marshall. He is out of custody on supervised release.

Mr. Russo told Judge Kaleb Cockrum that "unfortunately due to some collateral issues regarding Mr. Marshall's employment, we are not prepared to resolve today."

Deputy District Attorney Carolyn Schaffer said the offer to resolve "will expire by trial confirmation."

Marshall was to plead guilty to the felony charge in Count 4,  PC 261.5 (d), statutory rape. There was no opposition to probation. Marshall was also supposed to enter a guilty plea for the misdemeanor charge in Count 1, PC 288 (c) (1), lewd acts with a minor under 14 with a 18 month deferred entry of judgement. The remaining counts would be dismissed.

Trial confirmation is October 4; jury trial is November 1.
