Report for Yahindi Silverbrand was received by the District Attorney's office on January 23 and it is being reviewed. She is Dave Silverbrand's wife and was arrested for domestic battery. The arresting agency was HCSO.
There had been no case filed by the DA as of 4:30 p.m. on January 23. She was still in custody at 5:20 p.m. on January 23. Monday was a holiday but as of Wednesday, she had not been arraigned and it had been 72 hours.
She was released per PC 849.5, "In any case in which a person is arrested and released and no accusatory pleading is filed charging him with an offense, any record of arrest of the person shall include a record of release. Thereafter, the arrest shall not be deemed an arrest, but a detention only."-- CA Legislative Code
