Conflict Counsel gets judgement of acquittal for a drunk in public trial from the Court
Deputy Conflict Counsel April Van Dyke got a judgement of acquittal in the PC 647(f), drunk in public trial. The prosecutor was Deputy District Attorney David Moutrie. Judge Timothy Canning presided over the jury trial.
The court found no reasonable jury could have found the DA presented enough evidence for a jury to convict the client. 6 jurors stayed afterward to say they were already ready to acquit. Some jurors said they were shocked the Eureka Police Department officer could not define probable cause.
The guy was asleep in his car near the Bayfront restaurant.
This is the drunk in public trial that caused a continuance in the Opera Alley murder preliminary hearing.
