Potential juror tells Judge: "He is not my husband! He is my boyfriend. I don't know why he said that!"




Four men and eight women were selected as jurors 9 minutes before the end of the day in murder suspect David Kobak's case. Selection of alternates will start tomorrow afternoon.



Juror #3 was the "hot seat" today with defense excusing majority of the jurors in that seat. There are less than 19 jurors left in the jury pool.

A couple ended up on the jury and one of them provided some levity this afternoon. Judge Gregory Elvine-Kreis mentioned her husband being excused. The recent graduate quipped, "He is not my husband! He is my boyfriend. I don't know why he said that!" eliciting laughter in the courtroom.

Judge Elvine-Kreis said, "maybe he has a surprise for you?" After more insistence from her that he was just her boyfriend, she went along with the banter. Ironically, both she and her boyfriend were excused by the People as potential jurors.

On her way out, she was teased again and asked to let everyone know when the wedding was scheduled. She said she would.

Witness list includes several EPD officers and DOJ employees and forensic pathologist, Dr. Mark Super. Evidence is expected to conclude by January 29.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Public Defender Casey Russo is Kobak's attorney.
