"When an expert is paid, it is relevant"
Judge Gregory Elvine-Kreis told the jurors in the David Kobak case," when an expert is paid, it is relevant." This was a clarification regarding defense expert Suzanne Perry.
Today, CA DOJ Senior Criminalist Dale Cloutier testified about Perry's testimony as well as a forensic alcohol expert and his analysis on the case. Cloutier had previously testified as a firearms and ballastic expert. He agreed with a couple of statements Perry made but mostly refuted Perry's testimony.
"Her description of ADME and use of metabolism indicated to me she was not familiar with the way alcohol impairment is described in the scientific community," said Cloutier.
Unlike Perry, Cloutier provided specifics and details on his training, specific sources and research examples. Again, I am not going into detail about his testimony.
Today the defense "rests their case." The People have three more witnesses and they are scheduled for tomorrow morning.
