Will David Kobak jury hear about his 1995 domestic violence record?


Looks like defense will be calling their alcohol expert in the David Kobak case this afternoon. She is expected to testify about how an older man's body metabolizes alcohol.



On Friday, outside the presence of the jury, a discussion was held about the People's intention to recall Kobak's girlfriend, Cheri Keel. This is to inquire about Kobak's domestic violence record in 1995. A 402 hearing will be held to see if that evidence will be allowed.

Given the picture Keel painted of Kobak, her knowledge of the DV record would impeach her credibility. It also puts a dent in the fragile, sweet natured image of Kobak the defense has portrayed.

Via cross, Deputy District Attorney Whitney Timm already established that Robert Rappe, a friend and character witness would testify only if it helped Kobak and Rappe did not like Loftus.
