"How can you assert privilege if you call the witness in trial?"

Once again, there was no in camera hearing as requested by the People. After ordering DA Investigator Jack Bernstein to be present, all that happened today was that his report was given to defense and a protective order was signed about the identity of the People's witness in that report.

The People intend to call that witness at trial so the identity will not be a permanent secret . Judge Wilson said the protective order regarding the witness' identity applied only to "these proceedings only. How can you assert privilege if you call the witness in trial?" he said to Deputy District Attorney Carolyn Schaffer.

He called today's hearing about "Brady type matters" and mentioned a possible 402 hearing, if requested by attorneys.

Catherine Fode is represented by Mr. Neal Sanders. Hector Godoy-Standley is represented by Mr. Russ Clanton. Brandon Mitchell is represented by Ms. Andrea Sullivan. Tamara Thomson is represented by Mr. David Nims.
Cesar Valenzuela is represented by  Deputy Public Defender Casey Russo.

Everyone except Fode and Valenzuela were present in court today. Fode's appearance was excused by Judge Wilson as this hearing did not pertain to her.

Trial confirmation is scheduled for January 14. Jury trial for January 21. Godoy-Standley has a evidentiary hearing scheduled for January 17.

The victim was Tyson Eduardo Claros.
