Judge Canning disqualified, Ray Christie files motion to dismiss, one reason alleged jury misconduct


Trial confirmation was scheduled for Ray Christie on this jury. There was also a motion to dismiss and a motion to return property on calendar this morning. It was rescheduled to tomorrow because Judge Timothy Canning was disqualified.

Christie's attorney Mr. Ken Bareilles  told me before court hat the defense is requesting a continuance for the trial and the motion to dismiss because Christie's other attorney, Mr. John Cogorno is waiting on transcripts from the jury trial. Christie is expected to enter a time waiver.

Jury misconduct is one of the reasons mentioned in motion to dismiss. The motion is filed citing Penal Code 1118.1 asking for an "entry of judgment of acquittal for insufficient evidence."

The first jury trial resulted in the jury being hopelessly deadlocked on the four felony counts and 10 of the misdemeanor counts. Of the remaining 28 misdemeanor counts, there were three not guilty votes.
