"The vast majority of blood was pooled around the upper body where Mr. Loftus was lying."


The jurors finished watching EPD Det. Ron Harpham's interview with murder suspect David Kobak today. Kobak said that Fred Loftus hit him in the face yet there were no injuries on Kobak's face. There were no injuries on his hands or abdomen. Det. Harpham took photos of Kobak after the interview.

There were some texts exchanged between Loftus and Kobak before August 25, 2017 but Kobak said "they were cool" after that communication.

Deputy District Attorney Whitney Timm had Det. Harpham identify photos and testify about evidence collection, bullets found and damage in Kobak's apartment and Kobak's autopsy.

10 cartridges were recovered from Kobak's residence. A bullet was recovered from Fred Loftus' stomach area and another bullet was found in Kobak's fridge. Kobak had turned off thec stove in the kitchen.

"The vast majority of blood was pooled around the upper body where Mr. Loftus was lying," said Det. Harpham. He was designated today as a ballistic and firearms expert.

Before lunch, Deputy Public Defender Casey Russo started his cross examination. From his questions, it is clear that he is trying to suggest that Kobak was too intoxicated and should not have been interviewed. He has yet to prove that besides defense suggestions and opinions.

So far, he has not been able to impeach any of Det. Harpham's testimony.  Detective Harpham was on the stand until late afternoon.

A lot of questions Mr. Russo asked and raised during cross that were pointed towards the defense theory were undone during redirect.

For example, Mr. Russo asked Det. Harpham why he didnt go to Ernie's bar. Det Harpham said he already had the breathylzer test, Kobak's blood alcohol level, statements by Kobak about how much he drank and that he knew Loftus' urine could be obtained for a test screen.

Kobak had the presence of mind to turn off the stove before he went to the bedroom. He answered Det. Harpham's questions about date of birth, where the rifle was, was able to stand on his own and take off his shirt for the photos. All this dispeled defense suggestions during cross that Kobak was too intoxicated to be interviewed.
