Two more defense witnesses bolster the People's case for murder suspect David Kobak




The first two witnesses in the David Kobak jury trial this morning told us nothing we already knew and once again ended up bolstering the People's case.

EPD Detective Jonathan Eckert administered the breathlyzer test on Kobak during his EPD interview. The first sample was taken at 7:15 p.m. and the second sample was at 7:17 p.m. His blood alcohol level was 0.16 percent, twice the legal limit.

No water or coffed is given to the person before the test to avoid regurgitation which creates mouth alcohol.

Scott Humphers, the CPT from St. Joe's hospital who did the legal blood draw bought a legal draw kit and said an alcohol free wipe is used in such requests. He confirmed what we already knew from EPD Officer Brian Ross and Jyoti Malik,the defense witness from DOJ that the blood draw was at 9: 11 p.m.

Unless there are combative issues,no documentation is made by the CPT. There were no issues with Kobak.

We started late and after a few minutes are now on break until 10:30 so technical equipment can be set up.
