David Kobak had a case of selective memory today
David Kobak took the stand today and testified.
Due to witness issues, his cross examination was delayed. Judge Gregory Elvine-Kreis talked with attorneys at the bench and is meeting with them privately tomorrow morning. After cross examination, how will his testimony fare?
The jury saw the 911 call, the EPD interview with EPD Senior Detective Ron Harpham and Kobak's testimony had information today that was not shared during the interview or the preliminary hearing such as his mother had Alzheimers, Fred Loftus' ex wife shot at Loftus, that Loftus followed him into the living room after striking him in the face in the kitchen.
Asked why Loftus' ex wife shot at him, Kobak said, "guess he was trying to beat her up."
Today for the first time Kobak mentioned what Loftus said to him that made Kobak shoot him. "He said he was going to beat me and kick my fucking ass."
He could remember details such as where he put the rifle on his bedroom but when the answers were not beneficial to him, he could not remember such as not having any memory of the interview with Det. Harpham.
Some of today's posts will have more details such as the gunshot wounds, some details from defense witnesses and Kobak's entire testimony when I have time and by this weekend.
