On the lam again, man arrested in hit and run for allegedly robbing 800 lbs of marijuana, escaped from jail in 2003, stole a police car and a gun

George Preston Daniels, most recently arrested in 2015, for 800 lbs of marijuana is on the lam, again. A bench warrant was issued late March 2016 for Daniels. This was from a 2016 case in which there is a petition to revoke his post release supervision.

His bail bond company, Bill Davidson bonds, also alerted the Humboldt County Sheriff's office and they are looking for Daniels.

Bill Davidson Bonds only bailed Daniels out for this recent case. I confirmed that with manager, Steve Payton.

In November 2015, Daniels was arrested, following an investigation of a hit and run and was arrested for allegedly robbing 800 pounds of freshly harvested marijuana.

In the 2015 case, Daniels is charged with Count 1, transportation of marijuana with a special allegation that he had a AR-15 "in the commission and attempted commission of the crime."

Count 2, possession of marijuana, same special allegation.

Count 3 and Count 4, possession by a felon with a prior.

Jail Escapee, Alleged Police Car Thief Arrested
By: James Fault
The Times-Standard....Found on 2/09/03

Eureka, California - The man who baffled the Humboldt County Sheriff's
Department for the past month by escaping from jail on September 8,
then stealing a police car Friday, is again in custody.

The gun he allegedly stole from the police car has not been recovered.
The Eureka Police Department announced that it found and arrested George
Preston Daniels, 37 at 9:30 a.m. Monday when officers were attempting to
interview people at an Albee Street home he was known to frequent.

Daniels forced open a door and escaped from the Humboldt County Jail in
September. At the time, deputies found an exterior door had been forced
open. The jail was placed in lockdown and an inmate count revealed
Daniels was missing. He had been in custody for numerous felony charges
including possession of a controlled substance, use of tear gas and
illegal possession of ammunition. Daniels was working in the jail
kitchen when he escaped.

On Friday, Daniels was spotted by a sheriff's deputy. The deputy
attempted to arrest Daniels, but he broke free and escaped into a
residential neighborhood. Daniels then apparently doubled back to
the deputy's patrol car, found the keys and used the vehicle to escape.

The area was subsequently searched by the Sheriff's Department, the
California Highway Patrol, U.S. Marshals and others in the Bald Hills
area, to no avail.

The car was discovered the next day near Wrigley Road, with a gun
missing. The type of gun has not been specified, but a local television
station reported it was an assault rifle.

The Sheriff's Department is withholding the name of the deputy who
managed to lose both his patrol car and a gun to Daniels.

Jane Doe gives graphic testimony of sexual assault and Daniels asking her "Do you like that?"

Jane Doe testified how a call to her boyfriend's trailer near Jacob's Avenue  resulted in her being detained by Jason Daniels, a former Sheriff's deputy. She was arguing with a friend Ruby, who she thought was sleeping with her boyfriend at that time.

Daniels responded to the ruckus and he did a pat down and put her friend in the backseat of the car and then put cuffs on Jane Doe. He told her she was not being arrested but being detained.

While Jane Doe was cuffed, with Ruby in the backseat of Daniel's patrol car and her boyfriend watching from his trailer a few feet away, Jane Doe said Daniels touched her breasts, pushed her against his patrol car, put his hands under her skirt, pushed her panties aside and "stuck his fingers inside her" and said, "Do you like that?" She said he had an erection and was grinding against her butt" while fingering her. He later asked her for a blowjob.

"I was afraid he was going to hurt me, he is the fucking law, he could shoot me, he could do anything he wants" is what Jane Doe said when Mr. Issac asked her why she didnt say anything or stop Daniels.

While testifying, Jane Doe's voice quivered with anger and frustration, dropping to a lower voice and embarrassment when having to relive her assault. Mr. Issac, the prosecutor in the case apologized for asking specific questions but explained gently it was necessary and Jane Doe relived her assault today in open court with Daniels a couple feet away directly in front of her and with his wife in the courtroom.

She had to tell every one present what she was wearing. "A skirt, panties, a shirt and a bra." She said Daniels first touched her shoulder over her clothes, then he pushed her against the vehicle, the front of her body was against the vehicle. "He had his lower portion grinding against my back part. Basically, he was feeling me up. He went from my shoulders down to my bust, down to my hips while grinding behind me. I started to laugh because I was thinking how stupid an officer would have to be to do this."

She said she did not say anything because "I was afraid he was gonna hurt me. He is the fucking law. He could shoot me. He can do anything he wants." She said he touched her over her clothes "until my vagina. He slipped my underwear aside and stuck his fingers inside me" and said, 'Do you like that'." She said the last part was for "maybe a minute and a half." While he was doing this, with his free hand, she said he was holding a flashlight, trying to "blind traffic or Ruby" but then stopped, she  because of the cars going by on the highway.

"I decided to go along with whatever was going on in his crazy fucking mind." At this point, Mr. Issac stopped her and said, "You are upset and angry because of the  presence of certain people in Court but out of respect for the Court, please watch your language."

Jane Doe said that after Daniels did all of this, he asked if Ruby and she needed a ride home. He called over the radio and said, "he was doing a transfer".She did not want Ruby to be alone so she went in the car when Daniels dropped Ruby off at the Clarion motel. Then she wanted to get back to her boyfriend and so she was with Daniels in his car going back to Jacob Avenue. Daniels asked her to ride in the front seat with him and this is when he asked for a "blowjob" and she refused. At this point, she said that Daniels said to her,"Don't say anything about what we did because I could be in a lot of trouble."

When she got out of the car at her boyfriend's house, she said she was irritated because "I was taken advantage of."

Three months after the "incident" Jane Doe was in jail and she told her lawyer (Glenn Brown) of this incident after she saw Daniels in the hallway in the jail and then talked to District Attorney staff. Seeing Daniels made her feel unsafe and brought back memories of her being abused as a child. :I was molested when I was little."

On cross examination by Mr. Betts, Jane Doe repeated her account and was very consistent. Mr. Betts asked her about a statement to DA Investigator Kyla Baxley claiming she said, "it was okay" to Daniels when he was touching her.

Jane Doe said, "I didn't say it was okay. I was joking around, like in a porno. I was surprised." Jane Doe said Ruby told her that she saw what Daniels did to her and so did her boyfriend Jose but that he was jealous and told her, "Why don't you go back with that cop?"

On re-direct, she told Mr. Isaac that she stayed quiet because she did "not want to get anyone in trouble." She added, "as I learnt later that are lot of repercusssions from accusing a police officer."

Jane Doe testified about death threats  made to her by a "Chris" claiming to be Daniels' family, if she testified. She ended up in a car with this guy after she got out of jail and needed to make money and a friend of hers said, "she could hook her up with a guy." Mr. Issac said, "you mean sex for money?" Jane Doe said this Chris drove her to the woods for this gig and brought up Daniels and put "a gun to her head" and described the many ways he could kill her and this was by the Hoops waystation.

At the end of her testimony, Mr. Isaac asked her questions about each specific contact with Daniels asking her if she wanted him to do that and she emphatically said no.

Medical staff in room where Jane Doe was during break.

Deputy District Attorney Brie Bennett walked in with one of the defense attorneys, Ms. Julia Fox saying "we need to talk to the judge about an emergency situation."

A key witness in the Jason Daniels case, Jane Doe who was on stand today for a few minutes could not walk by herself, seemed out of it, could not answer questions, claimed she was not on meds and alcohol, for at least a week and could not identify Daniels in court.

Jane Doe taken out on stretcher by City Ambulance staff and Humboldt Bay Fire employees.

Court is adjourned until 8:30 a.m tomorrow. Judge Timothy Cissna  repeated the admonition to jurors twice about not discussing the case and not looking at any TV, print or online reports, including headlines.

Court started this morning with testimony, opening statements, People's first two witnesses, DA Investigators Kyla Baxley and Tom Cooke.

Jane Doe was supposed to the next witness. She is the alleged victim in Count 1 and Count 2. She did not look like the same woman who testified at the preliminary hearing last year.

Daniels is charged with Count 1, sexual penetration by a foreign object (a felony), alleged victim Jane Doe #1; Count 2 Sexual battery, alleged victim Jane Doe #1 and Count 3, Unlawfully touching intimate part of other/abuse, alleged victim Jane Doe 2 (a misdemeanor).

"This case is not about sexual assault, it is about a con."

"This case is about what Jason Daniels did to two women when he was a Sergeant at the Sheriff's office," is what Deputy District Attorney Brie Bennett said to the jurors in the Jason Daniel's case this morning during her opening statement.

Ms. Bennett said that there would be a number of witnesses besides the two alleged victims which would include investigators and Department of Justice.

"I expect you will hear about Jane Doe #1 and 2," said Ms. Bennett. "I don't think either will deny they have used drugs; I don't think either will deny that they have had run ins with the law" and referred to the fact that they both had "a troubled past."

"I just ask you to listen to them with an open mind and without a bias," said Ms. Bennett. "I expect when you hear from these victims; these vulnerable women; you will believe them."

Ms. Bennett summarized the alleged incidents and recounted what both alleged victims said in their testimony and at the preliminary hearing. Details in links below.

Ms. Julia Fox, one of Daniels ' attorneys, gave the opening statement for the defense. She raised questions about the alleged victim's testimonies, the timing of the complaint and whether their claims were reasonable.

"No good deed goes unpunished," said Ms. Fox. "This case is not about sexual assault, it is about a con. It's about a con by two seasoned convicts and Jason Daniels is caught in the crosshairs."

"Jason Daniels fell prey to two cunning survivors," said Ms. Fox.

Ms. Fox said that when Daniels was at the location where he encountered Jane Doe #1 after answering a call, "he tells dispatch where he is, tells other officers where he is." Ms. Fox said that Daniels did not cuff either Jane Doe #1 or her friend Ruby and he did a lawful search before giving them a courtesy ride and found nothing on them. The ride was for their safety. The search for his safety.

Recounting Jane Doe 1 and 2's testimonies, Ms. Fox said, "Clearly their stories diverged, that's why he is here." She said Daniels had denied the allegations "vehemently." That in a pre text meeting with Jane Doe #1, he walked away and wrote a memo about what happened at that pre text meeting right after to alert his superiors.

She asked the jurors if it was "reasonable" that someone who had just been assaulted would get into a car with the man who attacked her. She mentioned inconsistencies in Jane Doe 2's version of what happened, in three different interviews, "two under oath." Ms. Fox said Jane Doe #2 filed a civil suit against Daniels and would not give a deposition and then the case was dismissed.

Ms. Fox said that the defense will put EPD Officer Ryan McElroy on the stand and he will testify that he had an interaction with Jane Doe #1, after the allegations against Daniels had come out, and Jane Doe #1 gave him a false name and when he found oout who she was, she said something to the effect of "I've gotten cops fired before, don't be next."

Ms. Fox said that Jane Doe #2 came forth after details were "plastered in the press" about Jane Doe #1 and Daniels. She also tried to raise question about why it took the DA's office "almost a year" to file charges.

Former Sheriff deputy held to answer on charges against 1 victim, insufficient evidence for other victim's charges

Former Sheriff Deputy Jason Daniels was charged with three felony counts for the preliminary hearing: Count 1 penetration by a foreign object and Counts 2 and 3 sexual battery. People represented by Mr. Andrew Isaac. Defense attorneys Julia Fox and Steven Betts from the Bay area.

The Judge rejected defense's arguments about "consent issue" regarding Count 1 and Count 2 which related to the first victim. The defense tried to make issue of a statement that Jane Doe's ex boyfriend had given and that she got into the car with Daniels after the assault. Jane Doe's testimony in court this morning refutes this assertion by defense and explains the event of the night and her state of mind.

Judge Michael Beecher said he found "sufficient credible evidence" to support the charges and that he found the victim's testimony "credible."

Defense Counsel got third Count dismissed citing Calcrim Code that "there was no skin to skin contact." Mr. Betts said that Daniels touched Jane Roe "over her sweater" and that the People had failed to prove the elements that needed to be met. From Mr. Issac's remarks in Court, it looks like lesser charges for the second victim could be filed as a misdemeanor when Daniels is arraigned on information for the jury trial. That charge does not require "skin to skin contact" to occur.

Arraignment on information for jury trial on April 7 in Courtroom 5 at 2 p.m..

Second victim referred to as Jane Roe was in a car with a male friend driving near Samoa bridge. The friend was lost and was driving slowly and he pulled over. Suddenly, lights came on and they saw Jason Daniel's police car. It was late at night. First Daniels spoke with the driver, then he asked Jane Roe if she was on probation. She was and for possession of heroin. He asked her to get out of the car and asked her "if she had anything that might hurt me or stick me." She told him needles and put them on the seat of the car. He had her approach him and he was standing at the back of the car. Daniels told her that he wanted to search her. She didn't think anything of it. She had been searched before but by a female officer. He had "her up against the car, facing the car by the trunk," Jane Roe testified. She was bent over with her hands on the car. While searching her, "he groped me." Jane Roe told Mr. Isaac that Daniels touched her breasts over her sweater. It was not a pat down, "he rubbed my breasts".

She said she was "wierded out." Daniels kept insisiting she "was holding out on him" and that she was hiding more stuff. He asked her to empty her pockets. Finding nothing, he still pressed her about concealing something. Jane Roe said she told him that she would pull down her pants to prove that he was wrong. And he took her up on that offer. She pulled her pants were down to her knees,  and said, "he bent over and said, 'You look really good down there."

"I felt violated but I was too scared to tell him that," said Roe. "I was on my period" and he commented on her tampon string." Jane Roe said that "I was looking at his name tag and he had it covered. I knew the whole thing was not right."

Daniels let her go and she and her friend drove away. Jane Roe said that except for her boyfriend, Brian Griesbach, she did not talk to anyone about this incident. While she was in jail last year, her boyfriend encouraged her to talk to her lawyer, Mr. Marek Reavis. When Mr. Issac asked her why she did not go to the police right after the incident, she said, "He is a cop and I'm just a normal person." She did not think anyone would believe her over Daniels.

The People had both victims testify. The defense did not cross examine the second victim. As their evidence, the defense called the DA investigator Kyla Baxley in this case to the stand as their only evidence. She testified that when she interviewed the first victim's ex-boyfriend that Jose Garcia confirmed to Investigator Baxley that after the alleged assault Jane Doe did tell him about the incident with Daniels. However Garcia who had broken up with Jane Doe when he was interviewed, told Investigator Baxley that Jane Doe told him, "an officer had felt her up that night and she liked it." This was the only statement that Mr. Betts asked of Investigator Baxley.

On cross examination, Mr. Isaac asked Ms. Baxley how Garcia seemed about the victim and her alleged assault and Investigator Baxley said, "he was indifferent." Garcia's statement contradicts the victim's testimony.

Through Mr. Issac, both victim's assked the Judge, that they did not wish to speak to the defense counsel or a defense investigator. This is according to the Victim's Rights in California, link below.

Jury trial for Jason Daniels charged with off duty sexual assault charges set for June 15
Jury trial is now scheduled for June 15 largely to accommodate Jason Daniel's attorneys' schedule. Instead of his Bay area attorneys, Julia Fox and Steven Betts appearing with him in court today, Mr. Lawrence Killoran who is representing Daniels in a civil suit filed against him,  was present in court today with Daniels. As she has for all court hearings, Daniel's wife was with him.  Instead of Mr. Andrew Isaac who is prosecuting the case, DDA Brie Bennett was there today for the People.

In response to Judge Joyce Hinrichs,  time was waived by both parties. Mr. Killoran waived full reading of the complaint. Trial Confirmation is May 26 at 2 p.m. and Pre-Trial is May 12 at 2 p.m. in Courtroom 5.

What happens when you are on the lam, most recently arrested for alleged posession of 800 lbs of weed? Your wife gets sued for your bail bond

Bill Davidson Bonds filed a small claims lawsuit against Deborah Daniels on 10/18, George Daniels's wife.

Who is George Daniels? In this case, a man, most recently arrested for alleged possession of 800 lbs of marijuana, who is on the lam and despite rewards offered seems to have vanished into thin air.

A hearing is scheduled for November 18.

Brian Daniels keeps getting the Marci Kitchen treatment

Jury trial for Brian Daniels was scheduled for February 8. He has several cases. Criminal threats, DUI, hit and run charges but based on his age, Judge Christopher Wilson is willing to put him on probation.

Judge Wilson is the one who told Rickey Warren, "you want fries with that?" Yet, he seems to think that Daniels should just get off with a slap on the wrist.

"Did you want any of what Mr. Daniels did to you to happen?"

After the mid morning break on June 9, Mr. Steven Betz, one of Jason Daniels' attorneys, cross examined Jane Doe #1.

She explained that she was not on heroin and if she nodded off, it was due to detoxifying or closed her eyes, she was focusing on what the person was saying.

She told Mr. Betz that she had consistently used heroin, alcohol and meth.

She was consistent in her answers to him, repeating what she said in direct. If he seemed to misrepresent her testimony, she would respond by correcting him.

"No, no, no, no, no, no. He conducted a search on Ruby first and than me."

In response to a question about her boyfriend, at that time, now her ex boyfriend, she replied,

"I did not know Jose was watching but later he told me he was watching. He had seen what he had done and he was going to turn him in," said Jane Doe.

Mr. Betz read parts of her testimony from a transcript from the preliminary hearing. He said at the preliminary hearing, she said that she was not alone. Jane Doe said that was not her testimony referring to what he had read.

As he continued to read parts of the transcript and ask her questions, she said, "You are really hard to talk to" and "You are going back and forth, it is very confusing."

Answering his questions, she had said that Daniels did not take her handcuffs off after the search.

Mr. Betz, read another part from her preliminary testimony, stating that after Daniels searched her, he took her handcuffs off and Jane Doe said yes, that  was her testimony. "I'm confused, twice we had to go through that spot," explaining why.

Despite his efforts to impeach her, Mr. Betz was unsuccessful. An example: he said that in the preliminary hearing, Jane Doe said that Daniels did not touch her on the way back to her boyfriend but during his cross examination when he asked if Daniels had touched her "inappropriately", she said "I remember him touching my leg." Jane Doe said that she was "remembering a little more now."

Jane Doe told Mr. Betz that she told Jose not to call the police and told Ruby not to say anything.

Mr. Betz: "Do you have plans to file a civil suit in the future?"

Jane Doe: "Yes."

Mr. Betz: "You would be seeking monetary damages."

Jane Doe: "Hell, yeah. With all I have been through."

Mr. Betz: "Do you know Jane Doe #2?"

Jane Doe: "I have met her, but just in passing."

Jane Doe said that she had seen Jane Doe # 2, about five times and that they did not talk about the case.

She was very honest in answering Mr. Betz. She said a couple of DA Investigators met her last week where she was out of county, that they gave her $120 to store her stuff. She said, "it was $50 but I got behind and I asked them if I could pay it all off." Jane Doe #1 said that she had rented a friend's room.

Ms. Bennett then did a brief redirect examination, which was very effective. Jane Doe said she was 28, "will be 29 soon." She looked at some photos Ms. Bennett showed her of a Sheriff's patrol car and asked her if it was similar to what Daniels was driving in 2013.

Ms. Bennett: How many times have you been searched by law enforcement?

Jane Doe: "I am not really sure, 10 or 15."

Jane Doe could not recall if a DNA swab was collected from her.

Ms. Bennett: "Is it fair to say that your life has been disrupted by this case?"

Jane Doe: "Very much so."

Ms. Bennett: "Have you come to court multiple times? Spoken to a lot of people? Mr. Brown? DA Investigator Baxley?"

Jane Doe answered yes and then yes again when Ms. Bennett asked her "if she had attempted to stay clean while testifying" and "if that was difficult".

"I use heroin for pain," said Jane Doe. "I have had a lot of injuries.I have had relationships that were abusive."

Jane Doe told Ms. Bennett she was more alert when she was testifying at the preliminary hearing, and "I think it was the civil attorney who found me."

Ms. Bennett: "Has your health deteriorated since 2013?"

Jane Doe: "Yes."

Ms. Bennett: "Did you want any of what Mr. Daniels did to you to happen?"

Jane Doe: "No."

After Jane Doe # 1 finished testifying, DOJ senior criminalist Kay Belschner from the Eureka lab, took the stand for five minutes and testified about processing and swabbing Daniel's patrol vehicle and and swabs for reference samples from Daniels and Jane Doe #1. Since the Eureka lab does not do DNA analysis, the samples were sent to Redding.
