(Kobak's apartment complex)
CA DOJ Senior Criminalist Dale Cloutier wrapped up his testimony this morning. The cartridges and bullets matched the rifle taken from David Kobak's apartment.
Forensic pathologist Dr. Mark Super testified about Fred Loftus' autopsy and gunshot wounds. Loftus' cause of death was multiple gunshot wounds.
From an autopsy purpose, the gunshot wounds were of "indeterminate range." 6 of the wounds by themselves would be fatal, said Dr. Super, one unlikely to be fatal and one not fatal.
The wounds are listed in order from top of the body to the bottom as the autopsy was conducted and do not indicate the order of the shots by Kobak.
Gunshot wound #1: Wound on chest, struck cartilage, struck Loftus' right lung, "perforated his liver and diaphragm and exited his back. Just this wound in itself could have been fatal."
Gunshot #2: Wound entered left pectoral area, struck second rib, perforated lung, struck vertebrae, also exited right back.
Gunshot #3: Entered left upper arm, struck upper arm and grazed skin, then entered skin under armpit, then exited near armpit, then reentered armpit, went inside chest cavity and struck left third rib, struck lung, aorta, struck another rib and exited through back
Gunshot #4: Entered back of neck, struck cervical spine, struck major artery, left and second rib, perforated lungs and ribs and exited left chest
Gunshot #5: Struck left lung, struck two ribs and exited chest
Gunshot #6: Entered mid back, struck spine, struck aorta and abdomen, perforated small bowel. A bullet was found in left abdominal wall.
For gunshot eound 1 to 6, Dr. Super said each of those wounds by themselves were fatal.
Gunshot #7: Entered left shoulder, struck left humerus and shattered it, no exit. Fragment of bullet found inside arm. "Unlikely tp be fatal but could be."
Gunshot #8: Struck his right foot and exited top of the foot. "Not fatal"
The self defense theory just got shot down because two gunshot wounds that had entry from Loftus' neck had "short exit wounds suggesting something soft like the floor" had impact. There were also no abrasions on Loftus' knuckles.
Deputy Public Defender Casey Russo had just a couple of general questions for both witnesses and the answers did not support defense theory.
That shows the strength of the testimony by these two witnesses and the physical evidence.
Jurors got to see photos of the wounds and the autopsy.
