Update: I just checked on the case this afternoon and a clarification of sentencing is scheduled for October 9. The clarification is 50 years to life. The sentence was reduced to 25 years to life for each charge.
Sentencing and hearing on motion for new trial for convicted murderer Jake Combs' was continued to October 6. Motion for new trial was denied. Defense motion to lower the time served for enhancement was also denied. "It was a cold, callous, vicious execution," said Judge Kaleb Cockrum.
It was been a long two years with several continuances and finally today Trevor Earley's family got to watch Combs slink away quietly.
I reported details in my last post on September. Those details included that the defense motion filed on September 13 was one day before sentencing and that Combs had previously indicated that he was going to write an apology to Earley's family. His tears in court today were hollow because he and Deputy Public Defender Ben McLaughlin chose to delay sentencing and made the motion for a new trial. They could have shown this late remorse by allowing sentencing to proceed last month.
30 people were in court for Comb's sentencing including Second District Supervisor Michelle Bushnell. There were more watching via Zoom.
Judge Kaleb Cockrum sentenced Combs 100 years to life in prison. Two consecutive terms of 50 years to life. Combs has 618 days of credit.
If he is released, he will be on lifetime parole. Restitution is $10,000.
Several family members spoke for sentencing that took over an hour and half this morning. Combs kept his head down as they spoke.
The Earley family and friends are the most respectful I have seen in court. Trevor's mom thanked Deputy District Attorney Whitney Timm, DA Investigator Martin Morris, law enforcement and Victim Witness.
There is no way to summarize the powerful words they spoke in their victim statements Judge Cockrum's remarks to them before he sentenced Combs said it best. Thank you all for allowing us to see the Trevor you know and love. Penni Richardson, it was nice to meet you in person. I just wish it were under better circumstances.
Deputy District Attorney Whitney Timm is the prosecutor on this case. Deputy Public Defender Ben McLaughlin is Combs' attorney.
