Trial confirmation was scheduled this morning for former baseball coach and alleged molestor Benjamin Pesch. He was in court with Scott Pesch who left when court took a break at 10:40 a.m.
There have been ongoing discussions about a resolution. This morning after the case was sent to Courtroom 5 from Courtroom 1 and after sitting around all morning, shortly before lunch, the jury trial scheduled for 10/30 was vacated. Change of plea or resetting of trial is scheduled for November 7.
Deputy District Attorney Carolyn Schaffer is the prosecutor for this case. She is out on maternity leave. Deputy DA Trent Timm appeared on the case for the People. Deputy Conflict Counsel Zach Curtis is Pesch's attorney.
There are specifics Pesch had to agree about the plea and one of the things that the DA agreed to was that they would not file charges out of their jurisdiction. If you read my previous coverage, there is information. For Count 1, Pesch had to agree that "the bare minimum would be execution of sentence suspended." DA will not accept imposition of sentence suspended. The DA asked for this as a part of the resolution "so it cannot be wiped off his record."
