In 2019, charged with terrorizing and criminal threats, in 2020 DUI & possession of non prescribed meds, in 2023, salon employees file restraining order and claim he used Sandy Hook shooter's name

 


On Friday, I noticed a familiar name on the court calendar. When I checked court records , it confirmed what I thought. This was a civil harassment restraining order filed by Mariah Leann Garlinghouse vs Sean Michael Allman.

I have included some of the exhibits from official agencies and the request for TRO which has specifics. Commissioner Frances Greenleaf granted the TRO.

Allman was granted diversion for two years on 4/24/23 in his criminal case. In May 2023, Ms. Timm requested additional terms for his diversion.  

Since his arrest in 2019, Ms. Timm tried to keep the community safe but the local court system and a certain lenient judge failed the community.

I regularly covered hearings since Allman's arrest in 2019 and then his arrest again in 2020. In his 2019 case, Allman was charged with Count 1 Terrorizing or obstructing exercise of religion. Count 2 was criminal threats. Both counts pertain to the Episcopal Diocese of Northern California.

In 2020, Allman arrested for DUI and possession of medication without prescription charges. For both cases, Allman remained out of custody.  You can get away with anything in Humboldt with white privilege, money and if you are a "local."

Allman's family could afford a private attorney and a retired Judge who almost let a sexually violent predator back into the community foiled Ms. Timm's efforts. The same Judge who dragged out hearings and it was only the community showing up,  coverage of every hearing on this blog and public scrutiny that kept that unremorseful, unchanger predator from being released on the streets.

Considering what he was originally charged with, Allman got off easy. His cash bail was returned and Allman had a review hearing on 7/24. Mr. Ben Okin represented him in the criminal case. Ms. Andrea Sullivan only assisted as co counsel for the diversion.

If Allman had successfully completed treatment, the criminal charges would have been dismissed. The record of the arrest would have been sealed for most purposes. 

Judge Kelly Neel modified the diversion order in May 2023, however it was Retired Judge Feeney who granted the defense petition in November 2022, and found  Allman eligible for mental health diversion, Judge Feeney ruled that Allman does not pose an unreasonable risk to the community. 

I spoke with Deputy District Attorney Whitney Timm, the prosecutor on Allman's criminal case. She told me "A few weeks ago I filed a motion to terminate his Mental Health Diversion with this new information we received."

I will add court minutes on the ruling for the permanent request by Garlinghouse when they are available. When I checked on this case Friday morning, no proof of service had been filed so it was most likely continued. I checked court records on 10/30 and it was continued by the court to 11/17 for improper service. 

 According  to October 11 court minutes, Allman was at Sempervirens and release date was unknown. Unfortunately for the salon employees and the community,  Allman is no longer at Sempervirens.

On 10/11 & on 10/19 motion to terminate diversion was continued on 10/11 and 10/19 by defense. Next court date is 11/2  on the motion to terminate diversion and reinstate criminal proceedings. Diversion review PC 1001.36 is scheduled for 11/30; 2 year diversion review on 4/25/25.
