Former Eureka High School employee and convicted rapist Thomas Gowing was sentenced in May. This morning, there was a hearing on a defense motion to clarify sentence.
This was Deputy District Attorney Carolyn Schaffer's case. She is out on maternity leave. The case was initially in Courtroom 1 where Deputy DA Candance Myers was handling most of the 8:30 cases. It was sent over to Courtroom 5 and Deputy DA Luke Bernthal appeared on the case for the People.
Deputy Public Defender Ben McLaughlin is Gowing's attorney. Mr. McLaughlin's motion was granted by Judge Joyce Hinrichs. The request was an order to clarify for the jail that Gowing is eligible for SWAP. In my last post, I mentioned that Gowing does not have to register as a sex offender but that was done in June after his sentencing. Sex offender registration would have made him ineligible for SWAP.
