Deputy DA couldnt prove her request for a restraining order and now she may have one granted against her

 


Deputy District Attorney Candace Myers filed a restraining order request against Jason Paines and Deven Thompson. She was granted a temporary restraining order but after two days of hearing, things took a turn on October 6. 

According to Thompson, Commisioner Greenleaf granted Myers restraining order and then recused herself. I posted the recusal in the last post.

I already have an opinion on Myers as an attorney and person but I gave her the benefit of doubt when I posted yesterday. After I read Myers attachment, I had my doubts. What good did video evidence do Myers? 

If you cannot even get the opposing parties' name right when all it took me was a simple google search to confirm name with the address, that is incompetence and laziness.

As I mentioned in yesterday's post, I was provided with proof of Justin Paines' name with legal ID. Despites Paines stating his first name is Justin that has not been corrected in court minutes for 10/6. 

Myers lost. She is an attorney and she lost to two people pro per. The local courts and the criminal justice system in general is biased against pro per parties. Without the DA's office behind her, Myers couldn't even prove her case to make a restraining order permanent.

Judge Timothy Canning "just wrote us this new request to continue the hearing after he denied them a full restraining order due to insignificant proof," Thompson told me.

In the 10/6 court minutes, Judge Canning ruled that Myers did not prove harassment by clear and convincing evidence. The TROs against both Thompson and Paines previously granted were dissolved. 

I  have some information provided by Thompson and based on her verifying Paines' correct name, me and I verified the a filing by Thompson with the court clerk and court records in the system.

Thompson has filed an order to continue the hearing and her own civil harassment restraining order against "against her, her boyfriend, and both of her parents." Myers still needs to be served so the hearing on 10/6 was continued to 10/27 for Thompson's request. Commisioner Frances Greenleaf also recused herself on this case.

Initially I left out the first page because minor children were listed but after checking and talking with  Thompson, their mother, I added the first page with her permission. This isn't a sensitive sexual offense case where I usually use Jane or John Doe. These children have been traumatized by this incident and Myers is a prosecutor who is supposed to protect the public and Myers is the one who brought this into the legal system and public record by filing a restraining order.
