DA opening statement shows DA realizes weakness of case; defense makes excellent points about reasonable doubt

 


Opening statements in murder suspect Demetrius Coleman's jury trial were brief and the first People's witness, Rio Dell Police Department Sgt. John Beauchaine was on the stand by 9:28 a.m.

Deputy District Attorney Carolyn Schaffer is the prosecutor for the case. Ms. Andrea Sullivan is Coleman's attorney. Judge Kelly Neel is presiding over the trial. Rio Dell Police Chief Jeff Conner is seated at counsel table with Ms. Schaffer.

Coleman is charged with Count 1 PC 187 murder. First special allegation is PC 12022.53 (d) intentional discharge of a firearm; second special allegation is PC 190.2(a) (21) murder was intentional and perpetrated by means of discharging a firearm from a motor vehicle, ; third special allegation is PC 667 (b) (1) prior conviction of a serious and violent felony; fourth special allegation is PC 667 (b) (1) and fifth special allegation is PC 667 (a) (1).

Coleman has a prior conviction from Minnesota and a prior conviction from Butte County that is listed in the complaint.

Victim is Johnny Renfro. Charges against Coleman's co-defendant were dismissed after the preliminary hearing. Judge Timothy Canning did hold Coleman to answer after the preliminary hearing but commented on the evidence against him was not strong. The People disqualified Judge Canning from this case.
