Arrest for assault, child cruelty and other charges



On Oct. 24, 2020, at about 12:27 a.m., Humboldt County Sheriff’s deputies were dispatched to the 4000 block of E Street, in the County’s jurisdiction of Eureka, for the report of a disturbance with shots fired.

Deputies arrived on scene and made contact with a 31-year-old male victim outside of the residence. The victim told deputies that the suspect, 27-year-old Marvin Brice McGaughey, was inside of the residence with a 26-year-old female victim.


Deputies located the female victim and a small child uninjured inside the residence. McGaughey was also located inside the residence and detained for safety purposes. Through their investigation, deputies learned that McGaughey had reportedly become verbally aggressive with the female victim, at which time she contacted the male victim for assistance in leaving the residence. When the male victim arrived outside, McGaughey reportedly retrieved a firearm and shot at the door. McGaughey then retrieved a second firearm and walked outside pointing it at the victim. No one was injured during this incident.

McGaughey was arrested and booked into the Humboldt County Correctional Facility on charges of assault with a firearm on a person (PC 245(A)(2)), discharging a firearm in gross neglect (PC 246.3(A)), shooting at an inhabited dwelling (PC 246) and child cruelty (PC 273A(B)).
