Convicted child molestor John Beideman aka "Carpathian" had a hearing on his motion for return of property this morning. He was sentenced in December 2018 to a 16 year prison sentence as a part of a plea deal.
Beideman is currently housed at the California Medical Facility in Vacaville.
Deputy District Attorney Stacey Eads is the prosecutor for this case. Mr. Russ Clanton is Beideman's attorney.
The item was a box of letters Beideman wrote to his stepdaughter and Ms. Eads stated some of her objections on record. Since there was no legal basis, to object, Beideman will get all items he requested.
"Generally, I have no objection to majority of the evidence items, said Ms. Eads. "I do have some concerns about item DF 10, including redaction of some of the court's filings. "
Ms. Eads asked to discuss the redactions "off record and not on You Tube." After that private discussion, Mr. Clanton said he was not going to object to the redactions.
Ms. Eads asked Judge Kaleb Cockrum to strike certain wording in the filing of DF 10 which is the box of letters Beideman wrote to Jane Doe. Judge Cockrum granted that request.
"I have an objection of sorts to DF 10," said Ms. Eads. She said the letters were essential in the People's case against Beideman and in establishing the stalking behavior of Beideman. Had the case not resolved in a plea, this item was material to the People's case.
"It is not illegal or contraband but it is problematic," said Ms. Eads. "He drafted these letters on a daily basis. It was a very emotional issue for the mother" and showed Beideman's "obsession with the child."
Ms. Eads said there was no legal basis for her to object. Mr. Clanton characterized the letters as "non sexualized correspondence" and Beideman's feelings about his stepdaughter.
Judge Cockrum said the People can make copies of the letters prior to returning them to Beideman.
Beideman is the second client of Mr. Clanton and the second convicted child molestor wanting property back. The other one was Michael Franco.
