Kim Bergel has to pay $11,140 in attorney fees in her case against Cornelius Loewenstein

A hearing for attorney fees was scheduled in the Kimberly Bergel and Cornelius Loewenstein case this morning.

Mr. Arlie Capps is Loewenstein's attorney. On behalf of Loewenstein, Mr. Capps is requesting attorney fees per CCP 527.6 (5) and 1033.5 (a) (10) (b)

Eric Kirk is representing Bergel. One of the arguments in Bergel's opposition is that the awarding of attorney fees is discretionary.

Judge Kelly Neel is currently presiding over the Demetrius Coleman jury trial. There is a Visiting Judge in that courtroom today.

Livestream was not working, it got fixed later. I was able to get some information from Mr. Capps.

Mr. Capps said Judge Timothy Canning awarded a total of $11, 140 dollars. He ruled that 27.85 hours of attorney fees would be awarded and Mr. Capps' rate of $400 per hour. Travel time was not awarded.
