Jane Doe felt her molestation was her fault and wondered if her "other uncles would do this to her"



Convicted sex offender and molestor Michael Franco was sentenced today by Judge Kaleb Cockrum to the negotiated disposition of 21 years in state prison.

On February 24, Franco pleaded guilty pleaded guilty to an amended Count 10; PC 288.5 (a) continuous sexual abuse of a child.  The negotiated disposition is the aggravated term of 16 years for that count. He also admitted a special allegation PC 667.5 (a) that he has a prior conviction for lewd and lascivious act with a minor. This added 5 tears to his sentence.

Franco waived his right to appeal excluding any IAC claims. Franco has to register as a sex offender. Per PC 3000 (b) (4), his term for parole is 20 years and 6 months. Franco has 694 actual custody credits and at 15% another 104 credits. Fines and fees include two $1,000 fines and one $10,000 fine.

Victim impact statements by mother of Jane Doe, great aunt of Jane Doe and Jane Doe were read by Victim Witness Representative Caitlyn Lahaie.

Mother of Jane Doe: "This man will never serve the proper amount of time for the damage he has done to my daughter. He took her childhood years away making her believe she did something wrong."

Jane Doe's great aunt said that Jane Doe's father was incarcerated in prison for a violent crime leaving Jane Doe, her siblings and her mother "without protection." Jane Doe's mother was young. With help from family and friends, she worked hard, doing her best to raise her children. Jane Doe's best friend introduced "Mike" to the family. The woman was aware of Franco's criminal history as a "sexual predator. She trusted her friend and "he hurt her child. Mike used the opportunity to prey and victimize" Jane Doe. She said that Jane Doe remained quiet while Franco assaulted her because her siblings were asleep in the same room.

Jane Doe: "I feel like all what happened is my fault." She wondered if "her other uncles would do this to her. I didn't tell anyone because I thought he would do worse things to me."

Before he sentenced Franco, Judge Cockrum addressed Jane Doe and her family. " I really appreciate your writing those; it puts a human face on what happened. I want to assure Jane Doe she is normal. What happened to her is not normal."

Deputy District Attorney Stacey Eads is the prosecutor for this case. Mr. Russ Clanton is Franco's attorney.
