Convicted sex offender benefits from emergency bail schedule passed due to coronavirus pandemic

Convicted sex offender Richard Carl Konopacki posted bail and was released from custody yesterday at 11:34 p.m. He was in custody for 127 days for his most recent arrest.

Supervised release was denied by Judge Neel. He was "doing meth while taking care of his two children. The only partial employment Konopacki could show was through a family member. There was a reference about him not being in Fortuna but Eureka. " All this does not bode well for supervised release."

Konopacki told Judge Neel, "I have done a lot of soul searching while I have been in custody. I won't let you down."

"It's not that I disbelieve you," said Judge Neel. "There are no programs accepting anybody right now."

Bail on the misdemeanor cases was set to $0 due to the emergency bail schedule. Bail on another case set at $55,000 was reset to $25,000 which is according to the bail schedule.

He had three cases on calendar yesterday.  One from 2018, one from 2019 and one from 2020. Deputy Conflict Counsel Owen Tipps is Konopacki's attorney.

Deputy District Attorney Jane Mackie is the prosecutor on the case. At first she appeared by Zoom, then she was in court. Deputy DA Tobias Hasler was in court and also appeared on the case.

There was discussion about a video and discovery. People will get the full video from officer and alleged victim. Defense motion regarding discovery was granted.

Konopacki entered a 60 day waiver. His preliminary hearing was reset to May 7.

Megan's Law does not have his criminal history after the conviction listed but his name is frequent in the jail booking logs and he has cases in Humboldt Superior Court.
