Clayton Lasinski sentencing continued due to several issues with the plea


Sentencing for Clayton Lasinski was scheduled for April 30. The plea agreement was a stipulated term of 11 years in prison which Lasinski will serve at 85%.

Judge Christopher Wilson continued the sentencing to May 11 on the Court's own motion due to several issues with the plea.

The PPR report was missing, Judge Wilson needs to check authorities on exception to a firearm enhancement PC 12022.5 (d) , Probation didn't include 15% credits in total credits, Lasinski wasn't given certain admonishments so the plea may need to be taken again.

As of today, Lasinski has 1,408 total custody credits. Defense stated objection to fines recommended by Probation.

Deputy District Attorney Trent Timm is the prosecutor for the case. Deputy Conflict Counsel R.J.  Leohner is Lasinski's attorney.

On April 8, Lasinski pleaded guilty to:

Count Two 245 (b),assault upon a person with a semi-automatic and admitted the special allegation to that Count; 6 years mid term for Count Two and 3 years for special allegation.

Count 3 is PC 245 (a) (1), assault with a deadly weapon other than a firearm,  one year to be served consecutively. Metal object used in Count 3.

Count 6 PC 417.8, brandishing a firearm, one year to be served consecutively.

Count 7 PC 69, resisting an executive officer, term to be imposed by Judge,will be served concurrently

Count 15 VC27315, a seatbelt infraction

Count 17 (added count) PC 245 (a) (1) to be served concurrently.

Lasinski cannot possess firearms or ammunition for life.

No alleged victims to address Court before sentencing.
