DA and defense come to an agreement on plea for Clayton Lasinski



Clayton Lasinski was calendared on April 8 for change of plea. It was originally scheduled for 5/19, but "we came to an agreement so they advanced it," said Deputy District Attorney Trent Timm who is the prosecutor for the case. Deputy Conflict Counsel R.J.  Leohner is Lasinski's attorney.

The plea was expected so this isn't breaking news or a surprise.

1:30 update: the case was on this morning and finally this  the afternoon, Lasinski entered guilty pleas to some charges in a third amended complaint. Arbuckle waiver entered. Sentencing is on April 30.

The total prison term is still a stipulated term of 11 years in prison which Lasinski will serve at 85%. He has substantial credits. Lasinski cannot possess firearms or ammunition for life.

The final plea is pretty much the same as the defense offer mentioned at the last court hearing with a few changes. One added count in third amended complaint.

Lasinski pleaded guilty to:

Count Two 245 (b),assault upon a person with a semi-automatic and admitted the special allegation to that Count; 6 years mid term for Count Two and 3 years for special allegation.

Count 3 is PC 245 (a) (1), assault with a deadly weapon other than a firearm,  one year to be served consecutively. Metal object used in Count 3.

Count 6 PC 417.8, brandishing a firearm, one year to be served consecutively.

Count 7 PC 69, resisting an executive officer, term to be imposed by Judge,will be served concurrently

Count 15 VC27315, a seatbelt infraction

Count 17 (added count) PC 245 (a) (1) to be served concurrently.
