Jury trial for vehicular manslaughter and DUI suspect Gary Cudney scheduled to start today was vacated. Cudney is charged with the death of Dwight Davis aka "Dirty Dave."
Deputy District Attorney Steven Steward is the prosecutor for this case. Mr. Manny Daskal is Cudney's attorney.
Instead there is a trial confirmation, a hearing on a 995 motion and a motion to compel date scheduled for May 27. Mr. Daskal was asking for a trial setting in July but no decision was made regarding a jury trial date.
"Mr. Cudney has lost employment and cannot pay me," I am willing to continue at a court appointed rate." Mr. Daskal filed a motion for funding.
Judge Kelly Neel granted Mr. Daskal's request to continue to represent Cudney but at the court appointed rate.
