Before the jury was sworn in, Judge Gregory Elvine-Kreis told the jurors that both sides have a legal obligation to provide discovery in a timely manner.
The defense expert, Suzanne Perry, failed to disclose five charts to the People in a timely manner.
The jury in the David Kobak case was sworn in at 3:22 p.m. and they are deliberating. They left at 4:32 p.m. today.
