Luis and Carlos Portillo arrested for gang rape and rape by force

 

26 year old Luis Angel Portillo was arrested by Eureka Police Department on a Ramey warrant yesterday for PC 261(a)(1) forcible rape , PC 261(a)(2) forcible rape and PC 264.1 gang rape.

21 year old Carlos Portillo was arrested yesterday by EPD on a Ramey Warrant for PC 261(a)(1), PC 261(a)(2) and PC 264.1.

PC 261 (a) (1) or PC 261 (a) (2) can include rape by force of fear, threat of bodily injury, victim incapble of giving consent due to various factors. The DA's complaint included those factors but the penal codes are different. 

12/5: Luis and Carlos Portillo were arraigned this afternoon. Luis Portillo has retained Ms. Andrea Sullivan. Conflict Counsel's office was appointed for Carlos Portillo. Bail for both was set at $750,000.

OR/bail scheduled for December 7; preliminary hearing December 14. The complaint was amended on 12/5. Sometimes, it takes the clerk a while to update the pending charges screen to match the amended complaint.

12/7: OR/bail, supervised release denied by Judge Lawrence Killoran and status changed to no bail for both Luis and Carlos Portillo.

12/14: Preliminary hearing continued for both to 1/17/24. For Carlos because waiting on discovery; for Luis because Ms. Sullivan is in an ongoing multiple day preliminary hearing.

1/17/24: Preliminary hearing continued by defense to 2/1.
