HCSO Lt. Sam Williams preliminary hearing only had one witness, his wife's lover, Brian Kelsey, Jr.
Before evidence and testimony, a stipulation was entered into record that Lt. Sam Williams paid rent for the Mckinleyville "residence in question" until the alleged incident and was a lessee.
Kelsey met Danielle Williams at work. He is a mental health worker and she is a nurse at Sempervirens. They met in Fall 2022 and starting dating since "St. Patty's Day" in 2023.
"I knew she was married to Mr. Williams," said Kelsey. "My understanding is they were legally separated.
In December 2022, Lt. Sam Williams contacted Kelsey via email. Deputy District Attorney Emily Norgaard should Exhibit 1 to Kelsey. It was an email Lt. Sam Williams sent to Kelsey at his work address. In the email, Lt. Sam Williams introduced himself and asked to meet Kelsey.
On New Year's Eve, Lt. Sam Williams called Kelsey and Kelsey testified that Lt. Sam Williams said, "Hey Brian, if you ever contact Danielle again, I will kill you. I will beat you beyond recognition."
Kelsey said he responded, "Understood."
Obviously, Kelsey didn't.
Kelsey claimed he was fearful of his safety.
Apparently not because he kept sleeping with a married woman.
On March 24, Kelsey was at Danielle Williams house. He arrived there at 1 a.m. and said Lt. Sam Williams showed up at 5 a.m. The video that was played later has Lt. Sam Williams saying it was 5:07 a.m.
Kelsey said he was with Danielle Williams in the bedroom. "He was standing in the doorway with a gun in his hand. He said 'you are ruining my life'."
Kelsey testified that Lt. Sam Williams told him "to get his shit and get out." Kelsey believes the gun was in Lt. Sam Williams' right hand. Kelsey said the gun was pointed at him in the bedroom and "a couple of times in the bathroom."
Kelsey testified that Lt. Sam Williams said, "I am going to kill you"; "You are going to die" and "I am going to kill you motherfucker."
"Each time the gun was pointed at my chest or waist" said Kelsey. "At that time, I thought I was going to be shot. Mr. Williams chased me outside the bedroom into the dining room area." Kelsey said Lt. Sam Williams was in front of him and he took his belongings from the dining room table and that Lt. Sam Williams saw Kelsey's gun "and snatched it."
Ms. Norgaard played Exhibit 2, a video recording. You hear a voice saying, "It is 5:07 a.m. I pulled in my driveway and looks like Brian Kelsey's car. Ae are going in and going to tell him to leave."
Some darkness, camera moving around, keys opening the door to the house, more darkness, fidgeting and then light with the camera pointed where you only see the bottom of the bed.
"You are going to get the fuck out of my house," you hear Lt. Sam Williams say. "I am going to fucking kill you. Get your clothes."
"I am leaving. I am leaving." You here Kelsey say. He repeated the same phrase several times until he exited the house. Kelsey did sound scared. In the background, you hear Danielle Williams yelling, "stop."
"We are still married. This is my house. Whatever she has told you is a fucking lie."
We see Kelsey briefly but he is blurry. Ms. Norgaard stated the video had been pixelated because Kelsey had no clothes on.
We see the door to the house open and Lt. Williams says, "Tyler, Riley, call 911."
Ms. Norgaard asked Kelsey if he was fearful that Lt. Sam Williams was going to kill him that morning. Kelsey said, "yes."
Deputy Public Defender David Celli showed Kelsey an email from December 14, 2022. Mr. Celli said, "You met Danielle in October/November. At the end of November, she told you that Samand she were legally separated." Mr. Celli asked how that topic came up.
Kelsey responded that he told Danielle Williams that if she was with someone, he would respect that relationship.
Mr. Celli told Kelsey that in that email, Lt. Sam Williams refers to Danielle Williams as his wife.
Kelsey's response was people use titles even after they are not together.
Mr. Celli brought up the December 31 phone call and referring to a statement Kelsey gave to DA investigators, Mr. Celli said, "Do you remember telling them that you weren't afraid of Mr. Williams?"
Mr. Celli asked Kelsey about another statement Kelsey made to DA Investigator Dunn, "Obviously I was trying to get it."
"I was trying to get my gun as well as my keys and wallet, then Sam Williams took it."
